Important Legal Agreements

Nicholas Mark Johnson (hereafter referred to as GoHost4U) provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of GoHost4U are subject to the following terms of service:

Indemnification Policy

You agree to use all GoHost4U services and facilities at your own risk. GoHost4U specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall GoHost4U be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages.

Customer agrees that it shall defend, indemnify, save and hold GoHost4U harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against GoHost4U, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless GoHost4U against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with GoHost4U's server.

GoHost4U reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from GoHost4U's server. GoHost4U shall be the sole judge of what violates this Policy.

Billing

At this time we bill monthly, quarterly, semi-annually and annually, depending upon the plan. If you are not satisfied within your first 30 days we would be happy to provide you with a full refund (For some special offers the money-back-guaranteed day will be varied; and Domain Name registration fee is nonrefundable).

We accept Visa, Master Card. For web hosting plans we will setup your account without any paying. Clients are encouraged to pay by credit card as it is the easiest way to handle payment at this time. Their are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.

Late Payments

All accounts are billed according to the dates they were first activated on. If you do not pay for the service renewal within 5 days after deactivation, your account will be suspended. If you do not pay for the service renewal within 30 days after deactivation, your account will be terminated. We will attempt to email you a reminder 5 days until deactivation.

Acceptable Use Policy

All services provided by GoHost4U may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law and or European or other laws is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless GoHost4U and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all GoHost4U servers. This includes sites that include sexually explicit or hard-core images and/or advertising.

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.

Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.

All hosting services are provided based on the description of the service as advertised on our website. We reserve the right to change our hosting services in accordance with any changes enforced by our datacentre provider and or where we see fit to do so.

Unlimited services are subject to our fair use policy: Where an account uses more than 10GB of total storage including email accounts, hosting files and databases we reserve the right to cancel the account(s), move them to alternative servers or charge an additional amount.

Limitation of Liability

GoHost4U shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from GoHost4U servers going off-line or being unavailable for any reason whatsoever. Furthermore, GoHost4U shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of GoHost4U servers. All damages shall be limited to the immediate termination of service.

Domain Name Registrations and Transfers

GoHost4U shall not be responsible for any damages, including incidental and consequential damages, which may arise from any domain registration failing or the transfer of a domain name failing. Furthermore, GoHost4U shall not be responsible for any damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site or periods of inaccessible websites due to any domain not being available due to any registration, renewal, transfer, or other technical reason. All damages shall be limited to the immediate termination of service.

Domains are never owned. They are rented and as such your rights to the domain are subject to any renewals being paid and up to date. Furthermore where GoHost4U offers a domain as part of a package or a periodic service or maintenance contract and the client fails to pay for such service and or fails to keep up any agreed monthly payments for that service, maintenance contract or the package price is not paid in full then GoHost4U has the right to any of the following:

1. Cancel the domain and cease its obligation to renew the domain or maintain it

2. Transfer the domain into GoHost4U's ownership for GoHost4U to maintain, sell or use as it sees fit.

3. Market the domain for sale retaining any sale proceeds.

There is a minimum €50 transfer out fee for any domain. Premium domains may not be transferred away without prior agreement.

Domains which have not renewed in a timely manner may be subject to a redemption fee. This fee varies depending on the type of domain. Where a domain is not renewed and the domain falls into this redemption period then any charges to recover the domain, where the client requests such a recovery and where the domain has not already been transferred into GoHost4U's name or sold on by GoHost4U, will need to be paid in full plus a service charge of 25%

By using GoHost4U to register, transfer or renew a domain you agree to be bound by these terms and conditions and you must also be aware of your rights as laid out on the ICANN website:

GoHost4U is NOT the official registrar of any domains we are a reseller of SCIP whos terms and conditions of any registration, transfer or renewal will also form part of the terms and conditions of such registration, transfer or renewal.

GoHost4U offers a full refund of any hosting payments paid for in advance where the client is not satisfied with the service provided. The refund relates to monies paid to GoHost4U for hosting services and no other. Specifically no refunds can be made for domain purchases, website design, ssl certificates, image manipulation and supply or any other work carried out for the client by GoHost4U or GoHost4U's suppliers. Any refund will correspond to any payments the client has made in advance and will not include any payments for hosting which the client has had in the past except where GoHost4U agrees to backdate such a refund.

Disclaimer

GoHost4U cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by GoHost4U are resold. Thus, certain equipment, routing, software, and programming used by GoHost4U are not directly owned or written by GoHost4U. Moreover, GoHost4U holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as GoHost4U sees fit. FURTHERMORE, GoHost4U retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.

In all circumstances it is your responsibility to ensure any communications by GoHost4U are received. GoHost4U cannot be held responsible for any liability whatsoever due to GoHost4U's emails not being received. Please ensure you update your client information with an up to date email address which you receive and check regularly and ensure GoHost4U's emails are whitelisted for spam.GoHost4U recommend using a different email address to the any domain and or hosting service which GoHost4U provides.
